These Terms of Service ("Terms") govern your use of the AI assistant services offered by PhoneCalls.pro ("we", "our", or "us"). By subscribing to or using any of our services, you agree to be bound by these Terms.

1. Services Provided

PhoneCalls.pro offers AI-powered services including:

  • AI Phone Receptionist – answers and routes calls, schedules appointments, and provides business info.

  • AI Web Chat Assistant – chats with website visitors, provides answers, and assists with customer requests.

  • AI Outreach Agent – makes outbound calls to prospects or clients based on your input.

These services are powered by AI logic trained from your onboarding preferences and can be updated in your account portal.

2. Account Requirements

You must:

  • Be 18 years or older

  • Provide accurate business and contact information

  • Complete onboarding to activate your AI assistant

  • Maintain current billing and contact details in your account

3. Use of the Services

You may not use our services to:

  • Violate local, state, or federal laws

  • Send spam or unwanted robocalls

  • Collect or share sensitive personal data without consent

  • Harass, threaten, or impersonate others

You are responsible for monitoring the interactions your agent has with customers and ensuring compliance with applicable regulations.

4. Call Recording and AI Disclosure

PhoneCalls.pro may enable call and message recording and transcription features.

  • Recordings and transcripts are stored for 30 days

  • You are responsible for complying with call consent laws in your jurisdiction

  • If required by law, you must disclose that your callers are speaking with an AI assistant

5. Subscription & Billing

  • Subscriptions are charged on a recurring monthly or annual basis

  • All fees are billed in advance and auto-renew until canceled

  • You may manage your subscription through the account portal

  • Setup fees are non-refundable once configuration begins

6. Data Privacy

  • Data we collect (voice/chat transcripts, call data, onboarding preferences)

  • How long we retain data

  • Your rights to request deletion or modification

  • How we handle sensitive data

7. AI Behavior and Limitations

AI agents are trained using the preferences and logic you provide. We do not guarantee perfect performance, nor do we assume liability for errors, miscommunications, or losses resulting from AI interactions.

8. Cancellations and Termination

You may cancel your subscription at any time in the account portal. Your service will remain active until the end of the billing cycle. We reserve the right to suspend or terminate accounts that:

  • Violate these Terms

  • Abuse our systems or platform

  • Fail to pay subscription fees

9. Intellectual Property

All software, content, and logic provided by PhoneCalls.pro remains our intellectual property. You may not reproduce, resell, or sublicense any portion of our Services.

10. Limitation of Liability

To the fullest extent permitted by law, PhoneCalls.pro will not be liable for:

  • Indirect or incidental damages

  • Loss of business, revenue, or data

  • Any claims related to AI-generated responses

Total liability will not exceed the amount paid in the past 3 months of service.

11. Governing Law

These Terms shall be governed by and construed under the laws of [Insert Your State or Country], without regard to its conflict of law provisions.
